Terms of Service

These Terms of Service ("Terms") govern your use of SimLabDisplay (the "Service"), a web application operated by BML Innovations LLC("we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Who may use the Service

The Service is intended for use by educational institutions and their instructors, faculty, teaching assistants, and students in connection with running lab sessions. You may use the Service only if you are authorized by your institution and are able to form a binding agreement. If you use the Service on behalf of an institution, you represent that you are authorized to do so. Demo access additionally requires a signup password provided by an instructor.

Accounts

You are responsible for the accuracy of the information in your account, for keeping your login credentials secure, and for activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your permission.

Demo accounts

Demo access lets an institution trial the Service with accounts that hold no name and no email address. Creating a demo account requires a signup password provided by an instructor, together with a seat number and a PIN you choose. Your seat and PIN are your credentials: keep the PIN to yourself, since anyone who knows both can access that demo account. Your instructor can reset a PIN.

Demo accounts cannot upload photographs. Because a demo account has no email address, there is no self-service way to recover it — recovery goes through your instructor. A demo account that is never used to join a class may be deleted automatically, and we may limit, suspend, or close demo signup at any time.

Acceptable use

You agree not to:

  • Use the Service in violation of any law or your institution's policies.
  • Access, or try to access, data or accounts that are not yours, or circumvent the Service's access controls.
  • Disrupt, overload, scrape, or reverse-engineer the Service, or use it to build a competing product.
  • Upload unlawful, harmful, or infringing content, or use the Service to store information it isn't meant to hold (for example, payment card or health data).

Your data and privacy

Your use of the Service is also governed by our Privacy Policy. Student records entered into the Service belong to the institution, which controls them; we process that data on the institution's behalf and under any agreement in place.

Our intellectual property

The Service, including its software, design, and content (other than data you or your institution provide), is owned by BML Innovations LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

SimLabDisplay and the SimLabDisplay logo are trademarks of BML Innovations LLC. Nothing in these Terms grants you a right to use them.

Availability and changes

The Service is a tool that assists instructors in running labs; instructors remain responsible for their own labs and decisions. We may add, change, or remove features, and we do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance or suspend the Service when needed.

Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, BML Innovations LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising out of or relating to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we reasonably need to protect the Service or its users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

Changes to these Terms

We may update these Terms as the Service evolves. The date at the top reflects the latest revision; continued use after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
